Terms of service

Effective 25 August 2026

These Terms govern access to and use of Abnio Analytics and related services. If you use Abnio on behalf of an organization, you represent that you are authorized to bind that organization; “you” then means that organization.

Early-access proposals, order forms or signed agreements may include service, pricing, retention and support terms specific to a customer. If they conflict with these general Terms, the signed terms control.

1. Agreement and eligibility

You must have legal capacity to enter into this agreement and use Abnio only for lawful business purposes. By accepting an invitation, accessing an account or using the service, you agree to these Terms and our Privacy Policy.

2. Accounts and security

You are responsible for accurate account information, safeguarding credentials and recovery codes, enabling and maintaining required two-factor authentication, and activity under your account. Notify us promptly of suspected unauthorized access. Account access may not be shared in a way that bypasses agreed seat or role limits.

3. Acceptable use

You may not use Abnio to violate law or third-party rights; collect information without an appropriate legal basis or notice; monitor sites you do not control or lack authority to measure; send malware; attempt unauthorized access; interfere with service integrity; defeat quotas or access controls; probe other tenants; reverse engineer restricted parts of the service except where law permits; or use the service to build or benchmark a competing product without written permission.

We may rate-limit, suspend or block activity that threatens the service, users or third parties. Where practical, we will notify you and work to resolve non-urgent issues.

4. Customer data and privacy responsibilities

You retain rights in data submitted to or collected through your sites (“Customer Data”). You grant Abnio the limited right to host, process, transmit and display Customer Data as needed to provide, secure and support the service.

You are responsible for your sites, collection configuration, privacy notices, consent or other legal basis, responses to individuals, and ensuring instructions to Abnio comply with applicable law. If you enable server-log analytics, your notice must disclose that User-Agent strings are retained while raw IP addresses are not.

We do not sell Customer Data or use it for third-party advertising. We may use aggregated or de-identified operational information that cannot reasonably identify a customer, user or visitor to maintain and improve the service.

5. Intellectual property

Abnio and its licensors retain all rights in the service, software, design and documentation, excluding Customer Data. Subject to these Terms and any applicable order, we grant you a limited, non-exclusive, non-transferable right to use the service during the subscription or access period. Feedback may be used to improve Abnio without obligation, provided we do not publicly identify you without permission.

6. Service changes, availability and beta features

We may improve or change features while preserving the material function of paid services. Early-access, beta or experimental functionality may change, be incomplete or be discontinued and is provided without a service-level commitment unless agreed in writing. Planned maintenance and emergencies may affect availability.

7. Fees and taxes

Fees, usage allowances, billing terms and taxes are set out in the applicable proposal or order. Unless that document says otherwise, fees are non-refundable except where required by law. We may suspend paid access for overdue amounts after reasonable notice.

8. Suspension and termination

Either party may terminate as allowed by an order or written agreement. We may suspend or terminate access for material breach, unlawful use, security risk, non-payment or where required by law. Where feasible, we will provide notice and an opportunity to cure. On termination, your right to use the service ends; deletion and export follow the applicable agreement and retention process.

9. Third-party services

Features may interoperate with services such as Google Search Console, email providers, CDNs or hosting platforms. Your use of those services is governed by their own terms. We are not responsible for third-party changes, outages or acts outside our reasonable control.

10. Disclaimers

To the extent permitted by law, the service is provided “as is” and “as available”. We do not warrant uninterrupted or error-free operation, that analytics will capture every request, or that use of Abnio alone satisfies every privacy or regulatory requirement. Metrics are decision support, not legal, financial or professional advice.

11. Liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, revenue, goodwill or data. Abnio’s aggregate liability arising from the service will not exceed the amount paid or payable for the service during the twelve months before the event giving rise to the claim, except where a limitation is prohibited by law or a separate signed agreement states otherwise.

12. General

Neither party is liable for delay caused by events beyond reasonable control. You may not assign this agreement without consent, except with a merger or sale of substantially all relevant assets. If a provision is unenforceable, the rest remains effective. Failure to enforce a provision is not a waiver. Notices may be sent electronically. Applicable governing law and dispute terms will be stated in the customer order or signed agreement.
